Lew Clayton's article, "Some Calls for 'Reform' of the Patent System" is featured in the April 14 New York Law Journal. The article focuses on the ongoing discussion of whether the current patent system needs to be changed. Organizations such as the Federal Trade Commission (FTC), the National Academy of Sciences (NAS), the American Intellectual Property Law Association (AIPLA) and companies that are both patent holders and defendants in patent litigation have concluded that the patent system is too expensive and unpredictable. Lew indicates that while the specific recommendations of the AIPLA, NAS and FTC may never be enacted, they are a good indication of the direction that the next wave of patent "reform" will take.
