As a partner in the Litigation Department, Jacqui handles complex commercial disputes for some of the world's leading companies, including private equity firms and their portfolio companies, in a wide range of industries. She has significant trial experience and a track record of success in antitrust and class action litigations, contract and commercial arbitrations, regulatory and internal investigations, bankruptcy litigation and mass tort litigations in courts across the country.
EXPERIENCE
Jacqui’s recent significant antitrust representations include:
- Roark Capital Group in its successful acquisition of Subway, a Connecticut-based fast food restaurant franchise.
- Bard in securing a complete defense verdict in a $450 million antitrust lawsuit following a three-week jury trial in the U.S. District Court for the Northern District of New York.
- Becton Dickinson in antitrust and false advertising litigation, including competitor cases and purchaser class actions alleging monopolization, exclusive dealing and bundled discounts.
- An American Healthcare Company in several class action antitrust lawsuits alleging a conspiracy to fix the price of pharmaceuticals.
- Giorgi Mushroom Co. and Giorgio Foods in a multi-defendant class action and individual actions alleging price fixing in the market for mushrooms.
Jacqui’s consumer, mass torts and complex litigation representations have included:
- Uber in thousands of tort lawsuits in California and around the country involving the Uber ridesharing app.
- Massage Envy Franchising in multi-plaintiff consumer deception and personal injury lawsuits in state courts in California, Florida, New Jersey and many other states.
- A global technology company in an arbitration victory against a spun-off entity concerning contractual agreements that governed the parties’ ongoing obligations to one another and to their joint clients after the spin-off.
- An international fintech company in merger related litigation in Delaware Chancery Court.
- A special committee of the board of a large natural gas company in an internal investigation.
- A large independent crude oil and natural gas producer and its insurer in a victory before an international arbitration panel regarding a dispute arising out of damages suffered at an off-shore oil platform in the North Sea. The panel rejected the reinsurer’s defenses, finding that our clients were entitled to complete coverage under the policy.
- A semiconductor company in defense of class action and derivative lawsuits, and in related internal and SEC investigations regarding various accounting issues.
- Salomon Smith Barney in a victory before an AAA arbitration panel regarding claims brought by a former client.
- IBM in unfair competition litigation related to non-compete agreements.
- A medical device manufacturer in securing a de minimis resolution for False Claims Act litigation regarding alleged violations of the Anti-Kickback Act.
Jacqui is the former co-chair of the Bankruptcy Litigation group. Her significant bankruptcy and restructuring representations include an ad hoc committee of cross-holders of PetSmart’s indebtness, The Official Committee of Unsecured Creditors of Quicksilver Resources Inc., a Texas-based oil and gas exploration and production company, and Noranda Aluminum Holding Corp., a leading U.S. producer of primary aluminum foil products, and its wholly owned subsidiaries in chapter 11 cases in the Eastern District of Missouri.
Jacqui maintains a significant pro bono practice and is active in the community. She has handled several cases and appeals on behalf of unaccompanied children seeking to secure lawful permanent residence in the United States. Jacqui is a member of the Board of Directors of Mobilization for Justice, which offers free legal help to low-income New Yorkers.
She was recognized by Law360 as one of four “Rising Stars” nationally in the health industry for her work on behalf of pharmaceutical and medical device manufacturing companies. She was also recognized by The Legal 500 US (2016-2017) as a leading lawyer in the antitrust area.
