John Carlin and Nathan Mitchell to Discuss Evolving Foreign Investment and National Security Landscape at ACI’s CFIUS Conference

National Security Practice Group Chair John Carlin and corporate counsel Nathan Mitchell will participate in the American Conference Institute’s 11th National Conference on CFIUS, the nation’s leading forum on the Committee on Foreign Investment in the United States. John will speak on a panel, “Critical Infrastructure,” focusing on safeguarding the infrastructure aspects of the June 2024 Executive Order, including assessing the vulnerability of U.S. ports and energy infrastructure; and discussing how government is thinking about critical minerals, and how our critical material supply chain is impacted by national security implications, among other topics. Nathan will participate in a strategy session, “High Stakes, Time Sensitive Decisions: The Biggest ‘What Ifs’ Affecting the Fate of Short, Medium and Long Term Transactions,” which will address decision making in connection with the CFIUS system, such as developing a mitigation negotiation strategy early in a transaction process, structuring a deal when there is urgency, and drafting an agreement amid the highest-risk possibilities.
